This instrument is the Customs Legislation Amendment (Ozone Protection and Synthetic Greenhouse Gas Management Consequential Amendments) Regulations 2017.

    Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Customs (Prohibited Exports) Regulations 1958

Subregulation 2(1) (definition of SGG)

Repeal the definition, substitute:

SGG or synthetic greenhouse gas means any of the following:

  1. (a)

    an HFC;

  2. (c)

    a PFC;

  3. (d)

    sulfur hexafluoride.

Subregulation 2(1)

Insert:

sulfur hexafluoride means the substance referred to in Part 11 of Schedule 15, whether existing alone or in a mixture.

Part 9 of Schedule 15 (table item 11)

Repeal the item.

Part 11 of Schedule 15 (table item 1)

Repeal the item, substitute:

Subregulation 2(1)

Insert:

sulfur hexafluoride means the substance referred to in Part 11 of Schedule 10, whether existing alone or in a mixture.

Subregulation 5K(6)

Omit “the conditions in paragraph 13(6A)(b) or (c) of the Ozone Protection and Synthetic Greenhouse Gas Management Act 1989 are satisfied”, substitute “subsection 13(5) or (6) of the Ozone Protection and Synthetic Greenhouse Gas Management Act 1989 applies”.

Repeal the item.
