Be i t therefore enacted b y t h e Queen ' s Mos t Excel len t Majes ty b y and wi th t h e advice and consent of t he Legislat ive Council a n d Legislat ive Assembly of N e w South W a l e s in P a r l i a m e n t assembled and by the au tho r i t y of t h e same as follows :—

2. E v e r y person who shall on or before t he passing of th is A c t have m a d e or entered in to a n y con t rac t or ag reement for t he sale or del ivery upon or a t any t ime after t h e t en th day of December one thousand e ight h u n d r e d and seventy-nine of any impor ted Spiri ts or W i n e s whereupon a n y addi t ional d u t y shal l be payable u n d e r t h e provisions of this A c t shall be a t l iber ty to add to the pr ice cont rac ted for so m u c h money as wil l be equiva lent to t he addi t ional d u t y wh ich shall

1. I n l ieu of t h e dut ies now chargeable on impor ted Spiri ts and W i n e s inc lud ing all such now in bond the re shall be paid t h e duties following t h a t is to say—

shall by reason of such provisions have been paid or made payable on such Spiri ts a n d shal l be ent i t led by v i r tue of t h i s A c t to be pa id t h e same accordingly by t h e purchaser of such Spiri ts or W i n e s and to sue for and recover t h e same aga ins t such purchase r Provided t h a t in every ease where t h e pr ice cont rac ted for shall be so added to i t shal l be a t t he opt ion of such purchaser b y not ice in wr i t i ng u n d e r his h a n d to be served on the o ther p a r t y to such con t rac t w i th in four teen days after t he pass ing of this Ac t to declare t he cont rac t n u l l a n d void and t h e same shall be n u l l a n d void accordingly.

3. This Ac t shall be deemed to have come in to force on t h e t e n t h day of December one thousand e ight hundred and seventy-nine and shal l be stvled and m a y be cited as t h e " C u s t o m s Increased Dut ies A c t of 1879 . " '
