Customs (Endangered Species) Regulations (Amendment) (Cth)

GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of
the Federal Executive Council, hereby make the following Regulations under the
Dated 27 August 1981.

(a) by omitting from sub-regulation (1) “these Regulations” and substituting “these Regulations, unless the contrary intention appears”; and
(b) by omitting from sub-regulation (1) the definitions of “designated authority” and “the Convention” and substituting the following definitions:
“ ‘designated authority’ means the Minister of State for Home Affairs and Environment;
‘the Convention’ means the Convention on International Trade in Endangered Species of Wild Fauna and Flora done at
Washington in the United States of America on 3 March 1973, as amended and in force on 1 September 1981, a copy of which is set out in the Schedule.”.
(a) by omitting sub-regulation (1) and substituting the following sub-regulation:
“(1) The importation into Australia, not being an importation by way of introduction from the sea, of a specimen of a species included in Appendix I or Appendix II is prohibited unless the importer produces to the Collector—
(a) in the case of a specimen of a plant species included in Appendix II—
(i) an import permit granted by the Minister in respect of the specimen; or
(ii) a certificate that, in relation to the specimen, is a relevant certificate; or
(b) in any other case—an import permit granted by the Minister in respect of the specimen.”;
(b) by inserting in sub-regulation (2) “other than a specimen of a plant species that has been artificially propagated” after “a species included in Appendix I”;
(c) by inserting in sub-regulation (3) “or a specimen of a plant species included in Appendix I that has been artificially propagated” after “included in Appendix II”;
(d) by omitting from paragraph (a) of sub-regulation (3) “other”; and
(e) by adding at the end thereof the following sub-regulation:
“(5) In sub-regulation (1), ‘relevant certificate’, in relation to a specimen of a plant species included in Appendix II, means a certificate given by the relevant authority of the country from which the specimen is exported or re-exported to the effect that the relevant authority is satisfied as to one of the following matters, namely:
(a) that the specimen was artificially propagated;
(b) that the specimen is a part of a specimen of a plant species that was artificially propagated;
(c) that the specimen is derived from a specimen of a plant species that was artificially propagated.”.
(a) by omitting sub-regulation (1) and substituting the following sub-regulation:
“(1) The exportation from Australia of a specimen of a species included in Appendix I or Appendix II is prohibited unless the exporter produces to the Collector—
(a) in the case of a specimen of a plant species included in Appendix II that has been artificially propagated—an export permit granted by the Minister in respect of the specimen or in respect of a class of such specimens that includes that specimen; or
(b) in any other case—an export permit granted by the Minister in respect of the specimen.”;
(b) by inserting in sub-regulation (2) “other than a specimen of a plant species that has been artificially propagated” after “in Appendix I” ;
(c) by inserting in sub-regulation (3) “or a specimen of a plant species included in Appendix I that has been artificially propagated” after “in Appendix II”; and
(d) by inserting after sub-regulation (3) the following sub-regulation:
“(3a) The Minister shall not grant an export permit under sub-regulation (1) in respect of a class of specimens unless the designated authority advises that the exportation of the specimens included in the class will not be detrimental to the survival of the species to which the specimens belong.”.
(a) by omitting sub-regulation (1) and substituting the following sub-regulation:
“(1) Where the consent or permission in writing of the Minister is required under a provision of the Customs (Prohibited Imports) Regulations other than sub-regulation 4 (1) (in so far as it relates to goods specified in item 14 in the Second Schedule) for the importation of a specimen of a species included in Appendix I or Appendix II, an import permit granted by the Minister under these
Regulations for the importation into Australia of that specimen or a certificate that, in relation to that specimen, is a relevant certificate for the purposes of sub-regulation 4 (1) of these Regulations shall, for the purposes of that provision of the Customs (Prohibited Imports) Regulations, be deemed to be the consent or permission in writing of the Minister to import the specimen.”; and
(b) by omitting from sub-regulation (2) “other than regulation 6”.
INTERPRETATION:
1. Species included in these appendices are referred to:
(a) by the name of the species; or
(b) as being all of the species included in a higher tax on or designated part thereof.
2. The abbreviation “spp.” is used to denote all species of a higher taxon.
3. Other references to tax a higher than species are for the purposes of information or classification only.
4. The abbreviation “p.e.” is used to denote species which are possibly extinct.
5. An asterisk (*) placed against the name of a species or higher tax on indicates that one or more geographically separate populations, subspecies or species of that species or tax on are included in Appendix I and that these populations, subspecies or species are excluded from Appendix II.
6. Two asterisks (**) placed against the name of a species or higher tax on indicate that one or more geographically separate populations, subspecies or species of that species or tax on are included in Appendix II and that these populations, subspecies or species are excluded from Appendix I.
7. The symbol (+) followed by a number placed against the name of a species or higher tax on denotes that only designated geographically separate populations, subspecies or species of that species or tax on are included in the appendix concerned, as follows:

+204 All North American subspecies
+205 Asian population

8. The symbol (–) followed by a number placed against the name of a species or higher tax on denotes that designated geographically separate populations, subspecies, species, groups of species or families of that species or tax on are excluded from the appendix concerned, as follows:

9. Any plant, whether alive or dead, as well as any readily recognizable part or derivative of a plant of a species or higher tax on included in Appendix II are covered by the provisions of the Convention, unless the symbol (>) followed by a number is placed against the name of that species or tax on. In such a case, only the plant, whether alive or dead, and the parts or derivatives designated as follows are concerned:
