Act No. 32, 1898.

An Act for the establishment of Duties of Customs; for the alteration of existing" duties; to make permanent certain dimin­ ishing duties; and for purposes connected with, consequent upon, and incidental to the

above object. [7th December, 1898.]
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legisla­ tive Assembly of New South Wales in Parliament assembled, and by the
authority of the same, as follows:—

1. The import duties of customs mentioned in the Schedule to this Act shall be levied and collected upon all goods therein mentioned on their importation, and upon all such goods in bond: Provided that

all goods imported for the supply of Her Majesty's service shall be
exempt from such import duties.

2. All contracts made on or before the third day of November, one thousand eight hundred and ninety-eight, for the sale or delivery, otherwise than in bond, of any goods the duty on which is newly imposed

or is increased by this Act, shall be subject to an increase in the contract
price of such goods corresponding in rate and amount with the duty so
imposed or with such increase of duty as the case may be.
3. The duties of Customs imposed by the Customs Duties Act
of 1895 (59 Vic, No. 18), on sugar, raw and refined, and glucose, solid—
upon molasses and treacle, glucose, liquid and syrup—upon biscuits,
confectionery (including cakes, comfits, liquorice, liquorice paste, lozenges
of all kinds, cocoanut in sugar, sugar-candy, succades, and sweetmeats),

jams and jellies, preserves and canned fruits—fruits boiled, peel, drained or dry, shall cease to be diminishing duties, and shall be collected, levied,

and paid as part of the permanent customs tariff, at the rates in force
at the commencement of this Act.

4. All powers and authorities conferred by the Customs Regu­ lation Act, 1879, upon the Collector or any other officer of Customs may be exercised and enforced by such officers in the administration

of this Act.

Nothing in this Act contained shall be deemed to alter or repeal any of the provisions of the Customs Regulation Act, 1879.

5. This Act shall be taken to have come into operation on the third day of November, one thousand eight hundred and ninety-eight and all duties levied and collected between the said day and the date

of the passing of this Act upon any goods mentioned in the Schedule to

to this Act on their importation, or upon any such goods in bond, shall, be deemed to have been levied and collected under the authority of this Act, and no action shall lie against ony person for or in respect of any thing done or omitted or refused to be done by such person which he might after the passing of this Act lawfully do, omit, or refuse to do.

6. This Act may be cited as the " Customs Duties Act, 1898."

of the duty of one penny per pound now chargeable) per lb. two pence.
