Customs (Cinematograph Films) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Customs Act 1901.

1.   Amendment

1.1   The Customs (Cinematograph Films) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 4 (Interpretation)

2.1   Subregulation 4 (1):

After the definition of “advertising matter”, insert:

“ ‘Board’ means the Censorship Board constituted by regulation 5;

‘Board of Review’ means the Film and Literature Board of Review established by regulation 35;”.

2.2   Subregulation 4 (1) (definition of “Censor”):

Omit the definition, substitute:

“ ‘Censor’ means a member of the Board or a Deputy Censor;

‘Chief Censor’ means the member of the Board appointed to be the Chief Censor under these Regulations;

‘Deputy Chief Censor’ means the member of the Board appointed to be the Deputy Chief Censor under these Regulations;”.

2.3   Subregulation 4 (1) (definition of “member of the Board”):

Omit the definition, substitute:

“ ‘member of the Board’ includes the Chief Censor, the Deputy Chief Censor and the Senior Censors;”.

2.4   Subregulation 4 (1):

After the definition of “public exhibition”, insert:

“ ‘Senior Censor’ means a person appointed to the Board as a Senior Censor;”.

2.5   Subregulation 4 (1) (definitions of “the Board”, “the Board of Review”, “the Chief Censor”, “the Deputy Chief Censor” and “the Senior Censor”:

Omit the definitions.

3.   Regulation 5 (Censorship Board)

3.1   Subregulation 5 (2):

Omit “the Senior Censor and not more than 9 other members.”, substitute “2 Senior Censors and not more than 11 other members.”.

4.   Regulation 6 (Appointment of persons to act as members of the Board)

4.1   Subregulation 6 (1):

Omit “the Senior Censor”, substitute “a Senior Censor”.

5.   Regulation 7A (Delegation by Chief Censor)

5.1   Subregulation 7A (1):

Omit “the Senior Censor”, substitute “a Senior Censor”.

6.   Regulation 39D (Additional functions of Censorship Board, Censor and Board of Review)

6.1   Subregulation 39D (1):

Omit “films and publications,”, substitute “films, publications and computer games,”.

6.2   New subregulation 39D (3):

“(3)

For the purposes of subregulation (1), ‘computer games’ has the same meaning as in the Classification of Publications Ordinance 1983 of the Australian Capital Territory.”.
