The Parliament of Australia enacts:

1Short title

This Act may be cited as the Customs Amendment (2007 Harmonized System Changes) Act 2006.

2Commencement

This Act commences on the day on which it receives the Royal Assent.

3Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments

Customs Act 1901

After subsection 269SD(2)

Insert:

  1. (2A)

    If, because of an amendment of a Customs Tariff, the CEO is satisfied that the tariff classification that is stated in a TCO to apply to the goods the subject of the TCO will not apply to those goods from a particular day, the CEO may:

    1. (a)

      make an order revoking the TCO with effect from that day; and

    2. (b)

      make a new TCO in respect of the goods with effect from that day.
