I, LIONEL BARRIE WOODWARD, Chief Executive Officer of Customs:
(a) under section 4A and subsection 64ACB(5) of the Customs Act 1901 (the Act), and subsection 33(3) of the Acts Interpretation Act 1901, revoke CEO Instrument of Approval No. 2 of 2004 that approved the ‘Crew Report’ (Form 3A (JUN 2004)) and ‘Crew Report’ (Form 3B (JUN 2004)) as an approved form for the purpose of making a documentary report on crew who will be on board a ship at the time of its arrival at a port; and
(b) under section 4A and subsection 64ACB(5) of the Act, approve the attached “Crew Report (Form 3B (September 2005))” as the approved form for the purpose of making a documentary report on crew who will be on board a ship at the time of its arrival at a port.
This instrument commences on the day after it is registered.

We require this information under section 64ACB of the Customs Act 1901 in order to assess crew for the risk they may present in relation to a range of Commonwealth laws. Under subsection 64ACB(8) of the Customs Act 1901, the information provided must be disclosed to the Department of Immigration and Multicultural and Indigenous Affairs. This information may also be disclosed to a number of agencies including the Department of Transport and Regional Services, the Australian Federal Police, Australian Crime Commission, Attorney-General’s Department and the Department of Foreign Affairs and Trade.
