| t h e F o u r t h in t i t u l ed "An | Act for | the general | regulation | of the | Customs |
| of New South Wales and its Dependencies" | a n d i t is expedient t o |
a l ter a n d a m e n d t h e same in t h e m a n n e r hereinafter provided A n d whereas by t h e said recited Ac t it is enac ted T h a t no vessel or boa t unde r t h e t onnage allowed by law to be regis tered shall be employed ' e i ther in t h e remova l of goods passengers or for any purpose w h a t soever unless du ly licensed according to t h e form the re in s ta ted and i t is expedient to enforce t h e same Be i t therefore enacted by the Governor of N e w South Wales w i th t he advice of t he Legis la t ive Council T h a t from and after t h e pass ing and publ ica t ion of th i s A c t
| or be a id ing assis t ing or concerned in t he unsh ipp ing of any spir i ts tobacco or o ther goods l iable to forfeiture unde r any law re l a t ing to t h e R e v e n u e of Cus toms in force in t h e said Colony or who shal l carry convey or conceal or be a id ing assis t ing or concerned in t h e ca r ry ing conveying or concealing of any such spir i ts tobacco or o ther goods | shall |
| every such vessel or boa t so employed w i t h o u t be ing duly | licensed | as |
aforesaid shal l be forfeited toge ther w i t h t h e tackle fu rn i tu re a n d appare l thereof a n d shal l a n d m a y be seized by any officer of H i s Majesty 's Cus toms and condemned and sold in l ike m a n n e r as any vessel or boat l iable to forfeiture unde r any o the r law re la t ing to t h e Revenue of Cus toms in force in t h e said Colony.

shal l he l iable to be deta ined a n d t a k e n before t w o or more Jus t i ces of t h e Peace for t h e said Colony to be deal t w i t h as hereinaf ter directed and t h a t i t shal l be lawful for any officer of Cus toms or o ther person ac t ing in his aid or assis tance a n d he a n d t hey is a n d arc hereby au thor ized empowered and requ i red to stop arres t a n d deta in every such person a n d to ca r ry and convey such person before such Jus t i ces accordingly.
3. A n d be i t fu r ther enac ted T h a t if any person or persons

| o ther law re l a t ing to t h e Revenue of Cus toms in force in t h e | said |
Colony shal l no t be de ta ined a t t h e t ime of so commi t t i ng t h e offence for wh ich he she or t hey is or a re so l iable or after de ten t ion shall m a k e his h e r or the i r escape it shal l a n d m a y be lawful for any officer of Cus toms or any person ac t ing in h i s aid or assistance to s top ar res t a n d deta in such person so l iable to de tent ion as aforesaid a t a n y t i m e

| 4. A n d be i t fu r ther enacted T h a t i t shall and | m a y | be | lawful |
| for a n y two or more J u s t i c e s of | t h e | Peace | as aforesaid | before w h o m |
any person l iable to be ar res ted and detained for u n s h i p p i n g ca r ry ing conveying or conceal ing or a id ing assis t ing or be ing concerned in u n s h i p p i n g ca r ry ing conveying or conceal ing any spir i ts tobacco or
| o ther goods l iable to forfeiture | under | th i s or any | law re l a t i ng | to t h e |
R e v e n u e of Cus toms in force in t h e said Colony shal l be carr ied on t h e confession of such person of such offence or upon proof thereof upon oa th of one or more credible wi tness or witnesses to convict such person of such offence a n d every such person so convicted as aforesaid shal l immedia te ly u p o n such convict ion pay in to t h e h a n d s of such Jus t i ces for t h e use of H i s Majes ty t h e pena l ty of one h u n d r e d pounds w i t h o u t any mi t iga t ion whatever for a n y such offence of which he shal l be convicted as aforesaid or in case of t h e non -paymen t thereof t h e said Jus t i ces are he reby au thor ized a n d requ i red to cause t h e same by w a r r a n t of distress a n d sale u n d e r the i r h a n d s a n d seals t o be levied u p o n t h e goods and chat te ls of any such person so convicted as afore said or in case i t shal l appear to such Jus t i ces e i ther u p o n the confes s ion of such person or otherwise t h a t such person h a s n o t sufficient goods and chat te l s whereon to levy t h e said pena l ty i t shal l be lawful for t h e said Jus t i ces a n d t h e y are he reby au thor ized and requi red by

or otherwise u n d e r th i s or any o ther law re la t ing to t h e Revenue of Cus toms in force in t h e said Colony i t shal l a n d m a y be lawful for t h e said Governor a t his discret ion to cause a n al lowance no t exceeding
six-pence

Colony and al l convictions for such offences a n d w a r r a n t s of Ju s t i ce s of t he Peace founded upon such convict ions shal l be d r a w n respectively in t h e form or to t he effect in t h e Schedule to th i s Ac t annexed .
| 8. A n d whereas i t is expedient t h a t t i m e | should be al lowed to |
p repa re informat ions convictions and w a r r a n t s of c o m m i t m e n t E e i t declared and enacted T h a t when any person or persons shal l have been arres ted and deta ined by any officer of Cus toms or any person or persons ac t ing in his aid or assis tance for any offence unde r th i s or any o ther law re la t ing to t he Revenue of Cus toms in force in t h e said Colony a n d shal l have been t aken and carr ied before any two Jus t i ces of t h e Peace to be deal t w i t h according to law if it shal l appear to such Jus t i ces t h a t t he r e is reasonable cause to deta in such person or persons such Jus t i ces m a y and they are hereby author ized to order such person or persons to be deta ined a reasonable t ime no t exceeding twenty-four hour s as well before as after any informat ion has been exhibi ted agains t any such p a r t y a n d a t t h e expi ra t ion of such t ime
