682 ANNO VICESIMO SECUNDO ELIZA ET A.E SECUN D AE REGINAE No. 80 of 1973 An Act enabling the carrying on of certain mining purposes by Currie bin Minerals Pty. Ltd. at a site not within the boundaries of a claim held by it, and for purposes connected therewith [ASSENTED TO 20TH DECEMBER, 1973] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title. This Act may be cited as the Currumbin Minerals Pty. Ltd. (Transfer of Treatment Plant) Act 1973. 2. Interpretation . In this Act, unless the contrary intention appears,- the claim " means Amalgamated Dredging Claim No. 43, Southport, held by Currumbin Minerals Pty. Ltd. under the provisions of The Mining Acts 1898 to 1967 and continued in force pursuant to the provisions of section 5 of the MiningAct1968-1973, and comprising Dredging Claim No. 30 and Amalgamated Dredging Claim No. 29 (itself comprising Dredging Claims Nos. 14, 17, 20, 21, 21A and 28); " the company " means Currumbin Minerals Pty. Ltd.; " the structure " means the treatment plant of the company situated adjacent to Currumbin Creek and within the boundaries of the claim.

The company may, without prejudice to the claim or the exercise or carrying out of its rights or entitlements in respect of the claim, remove the structure from within the boundaries of the claim and reconstruct it within the boundaries of that land being the shaded area shown on the plan contained in the Schedule (which land is hereinafter referred to as " the new site "). 4. Effect of removal. (1) Where the structure is removed and reconstructed as aforesaid, the carrying on by the company on the new site of the mining purposes of treating sand or ore or stacking or otherwise storing sand, ore or minerals shall be deemed to be a carrying on of such mining purposes within the boundaries of the claim. (2) Without limiting the generality of the foregoing, where the company, carries on mining purposes referred to in subsection (1) in accordance with the provisions contained therein, the employment of men by the company on the new site in conjunction with or in lieu of the employment of men by the company on the claim shall be deemed to be employment of them on the claim and there shall not be a failure to comply with the labour conditions relating to the claim by reason only that the men were employed on the new site and not on the claim.
