An Act to repeal an Act inti tuled " An Act to

" make Promissory Notes and Bills of Exchange
" payable in Spanish Dollars available as if such

" Notes and Bills had, been drawn payable in " Sterling Money of the Realm" and to promote the " circulation of Sterling Money of Great

" Britain in New South Wales." [12th July,
1826.]
WH E R E A S it is expedient t o repeal an Act of t h e Governor Council of t h e fifth year of H i s present Majesty in t i tu led

and

" An Act to make Promissory Notes and Bills of Exchange payable " in Spanish Dollars available as if such Notes and Bills had been " drawn payable in Sterling Honey of the Realm" Be i t therefore

enacted by H i s Excel lency t h e Governor of N e w South Wales by and

w i t h t h e advice of t h e Legis la t ive Council T h a t t h e said reci ted A c t shal l be and t h e same is hereby repealed save a n d except as to such Notes and Bills of E x c h a n g e as shall have been d rawn a n d bond fide

issued before t h e publ ica t ion of th i s A c t or Ordinance .

2. A n d whereas i t is expedient to p romote a n d render more

effectual t h e c i rculat ion of Br i t i sh Ster l ing Money in N e w Sou th
after
W a l e s a n d i ts Dependencies Be i t therefore enacted by a n d w i t h t h e
a u t h o r i t y a n d advice aforesaid t h a t a t ender a n d paymen t of F o u r
Shi l l ings and Four -pence of S ter l ing Money of Grea t Br i t a in shal l be
a n d be deemed to be equivalent t o t h e tender and paymen t of one
Spanish Dol lar and so in propor t ion for any grea ter or less a m o u n t

a n d shal l be a discharge of any debt which m a y after t h e pub l i sh ing of t h i s A c t be cont rac ted to be pa id in Spanish Dol lars as Money Provided however t h a t n o t h i n g here in contained shal l be const rued to affect any promise or cont rac t whereby Spanish Dol lars may be or m a y have been agreed to be paid or delivered as merchandize .

3 . A n d be i t fu r ther enacted T h a t Br i t i sh Copper Money shal l
be a legal t ender and p a y m e n t as aforesaid for i ts due propor t ion of
Br i t i sh Silver Money as by law established in Great Br i ta in Provided
always t h a t no person shal l be compelled to t ake more t h a n Twelve-
pence of Copper Money in one paymen t .
4. A n d be i t fur ther enacted T h a t all Bills of E x c h a n g e
Promissory Notes Orders Drafts or Unde r t ak ings in W r i t i n g be ing
negot iable or t ransferable for t he paymen t of any s u m of money less
t h a n Twenty Shi l l ings Ster l ing which shall or may be m a d e or issued

after t h e publ ica t ion of th i s Act shall he and are hereby declared to be absolu te ly void a n d of n o effect any law cus tom or usage to the

con t r a ry not wi ths tanding .

5. A n d be i t fu r ther enacted T h a t if any person or persons shal l after t h e publ ica t ion of th i s L a w or Ordinance by any act device or means "whatsoever m a k e or issue any such N o t e Order Draf t or Under tak ing as aforesaid be ing for a less s u m t h a n Twenty Shi l l ings Ster l ing or shall after t h e first of September nex t re-issue negociate or t ransfer any N o t e Order Draft or U n d e r t a k i n g for t h e p a y m e n t of money made and issued before t h e publ ica t ion of th i s L a w for any s u m of money lei s t h a n Twenty Shil l ings Ster l ing every such person shal l forfeit and pay for every such offence a s u m no t exceeding Twenty P o u n d s S ter l ing nor less t h a n F ive P o u n d s S ter l ing a t t h e discret ion of t h e .Justice of t h e Peace who shall hear and de te rmine such offence.

6. A: id be it fur ther enacted Tha t all fines and forfeitures imposed by this L a w or Ordinance shall and m a y be recovered in a s u m m a r y way before any Jus t i ce or Jus t i ces of t h e Peace and shall be paid appropr ia ted and accounted for according to t h e provisions of an Ac t of t h e Governor and Counci l in t i tu led " An Act to prevent " the harbouring of Runaway Convicts and the encouraging of Convicts

" tippling or gambling."
