CaseChat Overview and Summary
The central issue for the Commission was whether the agreement met the statutory criteria for approval under the Fair Work Act. Specifically, the Commission needed to determine if the agreement had been fairly negotiated, if it contained the necessary minimum terms and conditions, and if it complied with the provisions of the Act. The Commission also considered whether the agreement would have a detrimental effect on the operation of the business and whether it was in the best interests of the employees.
The Commission found that the agreement had been fairly negotiated and contained the necessary minimum terms and conditions. The agreement was also in compliance with the provisions of the Fair Work Act. The Commission was satisfied that the agreement would not have a detrimental effect on the operation of the business and that it was in the best interests of the employees. Accordingly, the Commission approved the Cumberland View Aged Services Health and Allied Services Enterprise Agreement 2015. The approval was registered with the Fair Work Commission on 16 August 2016.
