CaseChat Overview and Summary

In the Fair Work Commission, the applicant, Cumberland View Aged Care Services Pty Ltd trading as Cumberland View Aged Care Services, applied for approval of the Cumberland View Aged Services Pty Ltd Nurses Enterprise Agreement 2015. The respondents included the Registered Nurses’ Union of Australia, the Australian Nursing and Midwifery Federation, and various other unions. The dispute centred around the terms and conditions of employment for nurses within the aged care facility, including wages, working hours, leave entitlements, and other employment-related matters.

The central legal issues that the Commission had to address were whether the agreement met the formal requirements for approval under the Fair Work Act 2009 and if the agreement provided fair and reasonable terms for the employees. This included assessing if the agreement complied with the relevant provisions of the Act, particularly those related to minimum standards and the process for approval of enterprise agreements.

The Commission considered various submissions from both the applicant and the respondents, as well as broader policy implications of the agreement. It evaluated the agreement's provisions against the statutory minimum standards and assessed whether the agreement was genuinely negotiated. The Commission found that the agreement met the necessary criteria and was fair and reasonable. Consequently, the Commission approved the Cumberland View Aged Services Pty Ltd Nurses Enterprise Agreement 2015.

The final orders of the Commission were that the agreement be approved as a certified agreement, effective from 1 July 2015. This approval meant that the terms and conditions set out in the agreement would govern the employment of the nurses at the facility until the agreement's expiry or until superseded by another certified agreement.
