August, 1890.]
WH E R E A S , cer ta in proposed Pub l i c W o r k , namely : — " A l ine of Ra i lway
p u r s u a n t to t h e " Publ ic W o r k s A c t of 1 8 8 8 , " a
from Culca i rn to C o r o w a " was, on t h e s ix th day of Augus t , in t he
year one thousand eight h u n d r e d and e igh ty-n ine , duly submi t t ed

and explained by the Secretary for Publ ic W o r k s in t h e Legis la t ive Assembly, and such work was thereupon referred, on t h e mot ion of t h e said Minis ter , to t h e P a r l i a m e n t a r y S t and ing Commi t t ee on

P u b l i c W o r k s , which Commit tee repor ted thereon to t h e said Assembly
p u r s u a n t to t he said Act . A n d whereas on the e igh th day of May ,
in the year one t housand e ight h u n d r e d and n ine ty , t h e said Assembly

b y resolut ion declared " t h a t i t is expedient t h a t a l ine of Ra i lway from Culca i rn to Corowa, as referred by the Legislat ive Assembly to t h e P a r l i a m e n t a r y S tand ing Commi t t ee on Pub l ic W o r k s , be carr ied

out , w i th such of t h e modifications recommended b y the said
Commi t t ee as th i s H o u s e m a y hereafter de t e rmine . " A n d t h e said
resolut ion was notified in t h e Gazette on t he t h i r t e en th day of May ,
in the said year. Bo it therefore enacted by t h e Queen ' s Most Exce l l en t
m a y be necessary for t h e ca r ry ing out of t h e work he reby sanctioned. The p lan of such work hereinafter referred to is t h e p lan m a r k e d " Culcairn
Majes ty , by and w i t h t h e advice and consent of t he Legislat ive Council
and Legis la t ive Assembly of N e w Sou th W a l e s in P a r l i a m e n t assembled,

and by the au tho r i t y of t he same, as follows :—

1. This A c t may be cited as t he " Culca i rn to Corowa Ra i lway

A c t of 1890 , " and shall be read w i t h t h e " Pub l i c W o r k s A c t of
1 8 8 8 . "
2. The Publ ic W o r k more pa r t i cu la r ly described in t h e Schedule
to th i s A c t shal l be carried out by t he Secretary for P u b l i c W o r k s , or
t h e M e m b e r of t h e Execu t ive Counci l for t he t ime being charged w i t h
t h e dut ies of t he said Minis ter . A n d such Minis te r or M e m b e r
shall , for t h e purposes of th i s Act , and t h e " Pub l i c W o r k s A c t of

188S," be deemed and t aken to be t h e " C o n s t r u c t i n g A u t h o r i t y " au thor ized to en te r in to contracts , and to exercise all powers, do al l acts and th ings , and be responsible in respect of all obl igat ions and liabilities which can be done or incur red by a " Const ruct ing A u t h o r i t y "

unde r or p u r s u a n t to th is Act , or the said Pub l i c W o r k s Act , so far as
" C u l c a i m to Corowa Ra i lway , " signed b y the Secretary for P u b l i c
W o r k s , and counters igned by t h e A c t i n g Engineer- in-Chief for
Ra i lways , a n d deposited in t h e office of t h e Secretary for Pub l i c W o r k s .

3 . The cost of ca r ry ing out t h e work hereby sanctioned, esti­

ma t ed a t t he s u m of One h u n d r e d and e ighty-e ight thousand s e v e n
h u n d r e d a n d sixty-five pounds shall be defrayed from such Loan
Votes as are now or m a y hereafter be appl icable there to .

S C H E D U L E .

This line commences at a junct ion wi th t h e Sou thern Bai l way on the south side

of the Bi l labong Creek, nea r the Culcairn Stat ion, a t a po in t about three hundred and fifty-six miles from Sydney ; thence proceeds in a s t ra igh t direction to B u r r u m b u t t o c k ; thence to a crossing of t he Howlong and "Walbundry Boads , about t en and a half miles n o r t h of H o w l o n g ; thence passing to t he south of Oil Tree Lagoon, and down "Water

Reserve n u m b e r two thousand n ine h u n d r e d and forty-five to the Albury and Corowa
B o a d s ; t hence on the no r the rn side of t ha t road to a point a t N o r t h W a h g u n y a h , about

four h u n d r e d and t h r e e and a half miles from Sydney, and abou t two miles to t he east of t he Gove rnmen t township of Corowa, as shown on plan hereinbefore referred to, and subject to such deviations and modifications as may be considered desirable by the
