KIRBY J:   The applicant is not present today, is that correct?  The applicant is content that the matter be dealt with on the papers?

MR WHITINGTON:    They so advised the Court.

GUMMOW J:   We have considered the written arguments and the Court is of the view that no error is disclosed in the decision of the Full Court of the Supreme Court of South Australia.  Accordingly, the application is refused with costs.

AT 9.37 AM THE MATTER WAS CONCLUDED
