Crown Suits (Amendment) Act 1991

An Act to amend the Crown Suits Act 1989

[Notified in ACT Gazette S98:  2 October 1991]

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Crown Suits (Amendment) Act 1991.

Principal Act

2.  In this Act, “Principal Act” means the Crown Suits Act 1989.1

Rights of parties

3.  (1)  Section 8 of the Principal Act is amended by adding at the end the following subsection:

“(2)  Subsection (1) does not apply to any rights of a party created by or under a law that does not bind the Crown in right of the Territory.”.

(2)  The amendment effected by subsection (1) applies only in relation to suits brought after the commencement of this Act.
