An Act for the payment of Costs in Proceedings instituted on behalf of the Crown in matters relating to the Revenue and for the amend­ ment of the Procedure and Practice in Crown Suits. [29th December, 1856.]

WH E R E A S t h e Crown agains t t he Queen ' s subjects in respect of m a t t e r s
in divers proceedings i n s t i t u t ed by or on behalf of
r e l a t i ng to t h e R e v e n u e n o costs a re recovered by t h e Crown except
i n cer ta in cases a n d no costs a re paid by t h e Crown t o t h e subject

A n d whereas i t is expedient t o ass imila te t h e law as to t he recovery of costs in such proceedings by or on behalf of t h e Crown to t h a t in force as to proceedings be tween subject a n d subject Be i t therefore enac ted by t h e Queen ' s Mos t Exce l l en t Majesty by a n d w i t h t h e advice and consent of t he Legis la t ive Counci l and Legis la t ive Assembly of N e w South Wales in th i s p resen t P a r l i a m e n t assembled a n d by t h e

a u t h o r i t y of t h e same as follows :—

1. I n all informat ions act ions sui ts and o ther legal proceedings to be hereaf ter i n s t i t u t ed before any Cour t or T r ibuna l by or on behal f of t h e Crown agains t any corporat ion or person or persons in respect of any lands t enemen t s or he red i t ament s or of any goods or

cha t te l s be longing or acc ru ing to t h e Crown t h e proceeds whereof or

t h e r en t s or profits of which said l ands t enemen t s or he red i t amen t s by any A c t now in force or hereafter to be passed are to be carr ied to t h e Consol idated R e v e n u e F u n d of N e w South W a l e s or in respect of any s u m or sums of money due and owing to H e r Majesty by v i r t ue of any A c t r e la t ing to t h e Pub l i c R e v e n u e H e r Majes ty ' s A t t o r n e y

Genera l for t h e Colony shal l be ent i t led to recover costs for a n d on
behalf of H e r Majesty where j u d g m e n t shal l be given for t h e Crown
in t h e same m a n n e r a n d u n d e r t h e same ru les regu la t ions a n d p ro ­

visions as a rc or m a y be in force t o u c h i n g t h e p a y m e n t or receipt of costs in proceedings be tween subject and subject and such costs shal l be pa id in to t h e T r e a s u r y a n d shal l become p a r t of t h e Consolidated

R e v e n u e Fund .

2. I f in any such informat ion act ion suit or o ther proceeding

j u d g m e n t shal l be given aga ins t t he Crown the defendant or defendants
s i t t ing
shal l be ent i t led to recover costs in l ike m a n n e r a n d subject to t h e

same ru les and provisions as t h o u g h such proceeding h a d been had be tween subject and subject and i t shal l be lawful for t h e Colonial Treasure r upon t h e w a r r a n t of t h e Governor which h e is hereby

requ i red t o issue t o pay such costs out of any moneys w h i c h m a y be
hereafter voted by t h e Pa r l i amen t of t h e Colony for t h a t purpose .

3. A n d whereas t he procedure and prac t ice in informat ions sui ts a n d o ther proceedings ins t i tu ted by or on behalf of t he Crown r equ i r e a m e n d m e n t a n d i t is desirable t h a t t h e same should be assimi­ la ted as near ly as m a y be to t h e course of prac t ice and procedure now in force in act ions and sui ts be tween subject and subject Be i t enac ted Tha t i t shall be lawful for t h e J u d g e s of t h e Supreme

Cour t or any two of t h e m to m a k e all such genera l ru les a n d orders

for t h e r egu la t ion of t he p leading a n d prac t ice in such informat ions suits a n d o ther proceedings and to frame such wri t s and forms of proceedings as to t h e m m a y seem expedient for t he purpose aforesaid a n d all such ru les orders or regula t ions shal l be la id before b o t h H o u s e s of t he P a r l i a m e n t of t h e Colony if P a r l i a m e n t be t h e n s i t t ing

immedia te ly u p o n t h e m a k i n g of t h e same or if P a r l i a m e n t be n o t
s i t t ing t h e n wi th in five days after t h e n e x t mee t ing thereof a n d n o
such ru l e order or regu la t ion shall have effect u n t i l t h ree m o n t h s after
t h e same shal l have been so laid before bo th Houses of P a r l i a m e n t
and any r u l e order or r egu la t ion so m a d e shal l from and after such

t i m e aforesaid be b ind ing a n d obl igatory a n d be of t h e l ike force a n d effect as if t h e provisions conta ined the re in had been expressly enac ted by P a r l i a m e n t Provided always t h a t i t shall be lawful for t he Governor

in H e r Majes ty ' s n a m e by any P roc l ama t ion inser ted in t h e Govern­
ment Gazette or for e i ther of t h e Houses of P a r l i a m e n t by any Reso lu t ion
passed a t any t i m e wi th in th ree m o n t h s n e x t after such ru les orders

a n d regula t ions shal l have been laid before P a r l i a m e n t to suspend t h e whole or a n y p a r t of such ru les orders or regu la t ions a n d in such case t h e whole or such p a r t thereof as shall be so suspended shal l n o t be

b ind ing and obl iga tory .
