Crown Proceedings Regulations 2023

under the Crown Proceedings Act 1992

1Short title

These regulations may be cited as the Crown Proceedings Regulations 2023.

2Commencement

These regulations come into operation on the day on which they are made.

3Agency of the Crown

For the purposes of the definition of Crown in section 4 of the Crown Proceedings Act 1992, a person for the time being holding or acting in any of the following offices is declared to be an agency of the Crown:

  1. (a)

    the Auditor‑General;

  2. (b)

    the Commissioner for Equal Opportunity;

  3. (c)

    a Commissioner appointed under the Essential Services Commission Act 2002;

  4. (d)

    the Commissioner for Victims' Rights;

  5. (e)

    the Deputy Auditor‑General;

  6. (f)

    the Director of Public Prosecutions;

  7. (g)

    the Electoral Commissioner;

  8. (h)

    the Deputy Electoral Commissioner;

  9. (i)

    the Health and Community Services Complaints Commissioner;

  10. (j)

    the Ombudsman;

  11. (k)

    the Solicitor‑General.

Schedule 1—Repeal of Crown Proceedings Regulations 2008

The Crown Proceedings Regulations 2008 are repealed.
