BE it enacted by the K i n g ' s Most Exce l len t Majesty, by a n d with advice and consent of t he Legislat ive Council and Legislat ive

t h e

Assembly of N e w South Wales in P a r l i a m e n t assembled, and by t h e

au thor i ty of t he same, as follows :—

1. This Ac t may be cited as the " Crown Lands ( Improvemen t

Purchase) Act , 1909 , " and shall be read wi th the Crown Lands Ac t of 1881, a n d the Min ing Act , 1906.

2. (1) No twi th s t and ing a n y t h i n g contained in subsection four

of section sixteen of t h e Min ing Act , 1906, where any person is t h e holder c la iming t h r o u g h or by vir tue of regis trat ion effected prior to t he fifteenth day of July, one thousand n ine hundred and seven, in pur suance of regula t ions made under the enac tmen t s repealed by the M i n i n g Act , 1906, of a business area exceeding one quar te r of an acre, and not exceeding one acre, wi th in the suburban boundar ies of a n y town or vil lage as defined by the Crown Lands Act of 1881 , t he Governor may, upon the recommenda t ion of the local land board or t h e W e s t e r n Land Board of New South Wales , and upon applicat ion

be ing duly made by such person before or after the c o m m e n c e m e n t

of th is Act , sell and g ran t such area to t he appl icant .

(2) Eve ry such appl icat ion shall be deal t w i t h i n accordance

wi th the provisions of section forty-six of the Crown Lands Ac t of

1881 and the regula t ions made thereunder .

(3) Provided tha t t he Governor may m a k e it a t e r m of the

sale or g ran t of any area, t he subject of such applicat ion, t h a t a n y pa r t thereof recommended and specified by the local land board or the W e s t e r n L a n d Board of New South Wales may a t any t ime be resumed for s treets or lanes, or the widen ing of streets or lanes, w i t h o u t p a y m e n t of compensat ion o ther t h a n for t he va lue of improve­ men t s as appraised by the local land board or the W e s t e r n L a n d Board of N e w South Wales .

The appl icant shall , prior to comple t ing his purchase , be furnished with a plan or sketch showing the land specified in t he recommendat ion of any such board. Ac t
