His Excellency the Governor, with the advice of the Executive Council, has made the following By-law under the Crown Lands Act 1989.

Explanatory note

Clause 23 of the Crown Lands (General Reserves) By-law 1995 allows a public notice displayed on a reserve to prohibit persons having or keeping any dogs or other animals on the reserve unless the animal is a guide dog accompanying a person who is blind or hearing-impaired (clause 23 (2) (o) and (3)).

The object of this By-law is to amend the Crown Lands (General Reserves) By-law 1995 to ensure that it is consistent with the Disability Discrimination Act 1992 of the Commonwealth by providing that the exception to the prohibition in clause 23 applies to all animals trained to assist persons with a disability and not only guide dogs for the blind and hearing impaired.

This By-law is made under the Crown Lands Act 1989, including section 128

(the general by-law making power).

Clause 23 Regulation of conduct within reserve

Omit clause 23 (3). Insert instead:

(3)

Nothing in this clause prohibits a person with a disability (within the meaning of the Disability Discrimination Act 1992 of the Commonwealth) from being accompanied by an assistance animal (that is, an animal referred to in section 9 of that Act).
