Explanatory note

The object of this Regulation is to amend the savings and transitional provisions in Schedule 7 to the Crown

Land Management Act 2016 to extend until 1 July 2020 the transitional period for certain reserve trusts
managed by corporations under the repealed Crown Lands Act 1989.

This Regulation is made under the Crown Land Management Act 2016, including section 13.5 (the general regulation-making power) and clause 1 of Schedule 7.

1      Name of Regulation

This Regulation is the Crown Land Management Amendment Regulation 2019.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Crown Land Management Act 2016 No 58

(1) Schedule 7 Savings, transitional and other provisions

Insert in alphabetical order in clause 2 (1):

transition day means:

(a)	in relation to a transitional reserve trust managed by a local council—1 July 2019, or
(b)	in relation to a transitional reserve trust managed by a corporation—1 July 2020.

(2)	Schedule 7, clauses 7 (3) (b), 7A (12) (b) and (13) (paragraph (a) of the definition of
“successor”), 10A (6) (paragraph (b) of the definition of “continuation period”),
11 (1) (c), (1B), (2A), (5) and (10) (paragraph (a) of the definition of “former trust
land”), 32 (2A) (b) and 41A (6A) (b)
Omit “1 July 2019” wherever occurring. Insert instead “the transition day”.
(3)	Schedule 7, clause 11 (5A)
Omit “1 July 2019”. Insert instead “the relevant day”.
(4)	Schedule 7, clause 11 (10) Definitions
Insert in alphabetical order:

relevant day means:

(a)	in relation to a transitional reserve trust managed by an administrator immediately before 1 July 2019—1 July 2019, or
(b)	in relation to a transitional reserve trust managed by an administrator appointed on or after 1 July 2019—1 July 2020.
