CROWN EMPLOYEES APPEAL BOARD (AMEND-

MENT) ACT.

Act No. 38, 1952.

An Act to' amend the Crown Employees Appeal Board Act, 1944, in certain respects; and for purposes connected therewith. [Assented to, 7th November, 1952.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of New South
"Wales in Parliament assembled, and by the authority of
the same, as follows:—

1 . (1) This Act may be cited as the "Crown

Employees Appeal Board (Amendment) Act, 1952."

(2) The Crown Employees Appeal Board Act,

1944, as amended by the Governor pursuant to section
"two of the said Act and by this Act, may be cited as

the Crown Employees Appeal Board Act, 1944-1952.

2 . The Crown Employees Appeal Board Act, 1944, is

amended:—

(a)

by omitting from the definition of "Employer" in subsection one of section two the letter and symbols " ( e ) " and by inserting in lieu thereof

the letter and symbols " ( f ) " ;

(b)

by inserting next after subsection two of section six the following new subsect ions:—

(2A) (a) The members and a l t e rna te mem­ bers appointed in respect of any indus t r ia l union of employees regis tered unde r the Indus t r i a l Arb i t r a t ion Act, 1940-1952, the name of which has been inser ted in the F i r s t Schedule to t h i s Act before the commencement of the Crown Employees Appea l B o a r d (Amendment ) Act , 1952, p u r s u a n t to subsection two of section two of this Act, shall, for all purposes of this Act, be deemed to have been validly nominated by such union.

(b) Nominat ions of members and al ter­ na te members in respect of any union re fe r red to in p a r a g r a p h (a) of this subsection shall be lodged in the month of November in the y e a r one thousand nine hundred and fifty-three and

in each th i rd yea r thereaf ter .

(2B ) (a) Where , af ter the commencement of the Crown Employees Appea l Board (Amend­ ment) Act, 1952, the name of any indus t r ia l union of employees reg is te red under t h e Indus t r i a l Arb i t r a t ion Act, 1940-1952, is inser ted in the F i r s t Schedule to this Act, or the name of any person employing persons on behalf of the Crown is inser ted in the Second Schedule to this Act, the first nominat ion of members and a l te rna te members as officers'

r epresen ta t ives or employer s ' represen ta t ives in
respect of such union or employing au thor i ty shall be lodged within one month after the n a m e of such union or employing au thor i ty has been so inserted.
(b) The persons so nominated shall assume office on the da tes upon which the i r respect ive nominat ions take effect and shall, subject to this Act, if they assume office before the thirty-first day of December, one thousand nine hundred and fifty-three, hold office un t i l

the said day, and if they assume office dur ing a n y per iod of three yea r s succeeding the said day, hold office unt i l the thir ty-first day of December of the th i rd year of such succeeding period.

(c) Subsequent nominat ions of members a n d a l te rna te members as officers' r epresen ta ­ tives or employers ' represen ta t ives in respect of any union or employing au thor i ty to which th is subsection applies shall be lodged in the month of November next preceding the expira­ t ion of the t e rm of office of those persons who for the t ime being are holding office as members

a n d a l te rna te members .
(2c) P a r a g r a p h (b) of subsection two of this

section shall apply to and in respect of persons nominated p u r s u a n t to p a r a g r a p h (b) of

subsection (2A) of this section and p a r a g r a p h

(c) of subsection (2B ) of this section.

(c) by omitting from subsection one of section ten
the words " o n e thousand p o u n d s " and by
inser t ing in lieu thereof the words " o n e
thousand seven hundred and fifty p o u n d s " ;

(d)

by omitting from the Second Schedule the words—

" T h e Metropol i tan Meat I n d u s t r y Commis­

sioner.

a n d by inser t ing in lieu thereof the words—
