Crown Appointments Declaratory Act 1976
1,051 Mlteettsiuxt ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE REGINAE No. 92 of 1976 An Act to declare with respect to the holding of certain appointments under the Crown by existing members of the Legislative Assembly of Queensland [ASSENTED TO 17TH DECEMBER, 1976] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title . This Act may be cited as the Crown Appointments Declaratory Act 1976. 2. Certain appointments not offices of profit. (1) A member of the Legislative Assembly at 6 December 1976 who before that date- (a) was invested by or on behalf of the Crown with an authority of any kind whatever; (b) was appointed by or on behalf of the Crown or under the authority of an Act to any position whatever; or
1,052 Crown Appointments Declaratory Act 1976, No. 92 (c) stood in a relationship to the Crown or to any person on behalf of the Crown, whereby he would be taken to hold an office or place of profit under the Crown is hereby declared not to have held an office or place of profit under the Crown by reason of his holding such authority or appointment or standing in such relationship and, where his holding such authority or appointment or his standing in such relationship continues after the date aforesaid, is hereby declared not to hold by reason thereof an office or place of profit under the Crown. (2) Subsection (1) applies- (a) whether or not fees or other remuneration were or are paid to the member concerned on account of his holding the authority or appointment or his standing in the relationship referred to in that subsection or his doing anything pursuant thereto, or (b) whether the authority, appointment or relationship referred to in that subsection was invested, made or established at a time before or after the member concerned became a member of the Legislative Assembly.
