CRIMINAL RECORDS (SPENT CONVICTIONS) REGULATIONS 1993

Regulations under the Criminal Records (Spent Convictions) Act 1992

1Citation

These Regulations may be cited as the Criminal Records (Spent Convictions) Regulations 1993.

2Prescribed law enforcement agencies

For paragraph (n) of the definition law enforcement agency in section 3(1) of the Act, the following bodies are prescribed:

  • (a)

    the police force of New Zealand;

  • (b)

    the International Police Organisation, known as INTERPOL;

  • (c)

    the United Kingdom Criminal Records Bureau.

2AExemption for disclosure of information to Australian Crime Commission
  • (1)

    Section 12 of the Act does not apply in relation to disclosure by the Northern Territory Police Force of a spent record or information relating to a spent record to the Australian Crime Commission for incorporation into the police information sharing system known as the National Police Reference System.

    Note for subregulation (1)

    This regulation is made under section 19(3) of the Act.

3Exemption in relation to certain decisions under

Section 13 of the Act does not apply in relation to the making of a decision under the Private Security Act 1995 whether to grant, renew, suspend or cancel a licence.
