Criminal Procedure Amendment Regulations

(No. 2) 2022

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Criminal Procedure Amendment
Regulations (No. 2) 2022.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Criminal Procedure
Regulations 2005.

4.             Schedule 1 Form 5 amended

(1) In Schedule 1 Form 5 in the item for Doing nothing [Option 2] delete
“send” and insert:
lodge with
(2) In Schedule 1 Form 5 in the item for Pleading not guilty in writing
[Option 3]:
(a) delete “send” (1st occurrence) and insert:

lodge with

(b) delete the passage that begins with “To send” and ends

with “date.” and insert:

A written plea of not guilty must be lodged with the court at least 3 days before the

above hearing date —

1.         by means of the ECMS; 1 or

2.         by completing page 2 of this form and returning it to the court registry.

(3) In Schedule 1 Form 5 in the item for Pleading guilty in writing
[Option 4]:
(a) delete “send” (1st occurrence) and insert:

lodge with

(b) delete the passage that begins with “To send” and ends

with “date.” and insert:

A written plea of guilty must be lodged with the court at least 3 days before the above

hearing date —

1.         by means of the ECMS; 1 or

2.         by completing page 2 of this form and returning it to the court registry.

Attach any written explanation or information that you want the court to consider.

(4) In Schedule 1 Form 5 in the item for Service details delete
“details 1” and insert:

(5) In Schedule 1 Form 5 after the item for Service details delete the
note and insert:

1.        The electronic case management system (ECMS) can be accessed via the eCourts Portal of Western Australia at

2.        Service must be in accordance with the CPA Schedule 2 clause 2, 3 or 4 (see s. 33(3)). Insert here whichever manner of service was used.

(6) In Schedule 1 Form 5 in the item for Contact details in the
2nd column delete “Fax No.” and insert:
