Criminal Procedure Amendment

(Intervention Programs) Regulation 2018

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Criminal Procedure Act 1986.

Explanatory note

The objects of this Regulation are:

(a) to repeal the forum sentencing intervention program which was declared by the Criminal Procedure
Regulation 2017 to be an intervention program for the purposes of Part 4 of Chapter 7 of the
Criminal Procedure Act 1986, and
(b) to permit the Secretary to delegate his or her functions in relation to approving courses and issuing guidelines for the traffic offender intervention program.

This Regulation is made under the Criminal Procedure Act 1986, including sections 4 (the general regulation-making power), 347 (1) and (3) and 348 (2) (g).

1      Name of Regulation

This Regulation is the Criminal Procedure Amendment (Intervention Programs)
Regulation 2018.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Criminal Procedure Regulation 2017

(1) Part 8 Forum sentencing intervention program

Omit the Part.

(2) Clause 118 Delegation of functions
Insert after clause 118 (2):
(3) The Secretary may delegate to any person the exercise of any of the
functions conferred on the Secretary by clauses 104 and 106.
