Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Criminal Procedure Act 1986.

Explanatory note
The object of this Regulation is to amend the Criminal Procedure Regulation 2010 to provide that no fee is payable for a copy of the print out of any record of committal proceedings conducted in the Local Court by means of an ECM system within the meaning of Schedule 1 to the Electronic Transactions Act 2000.

This Regulation is made under the Criminal Procedure Act 1986, including sections 4 (the general regulation-making power) and 4A.

1      Name of Regulation

This Regulation is the Criminal Procedure Amendment (ECM
Committal Proceedings) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Criminal Procedure Regulation 2010

Clause 10 Amounts payable in relation to court proceedings

Insert at the end of clause 10:

(2) Despite subclause (1), no fee is payable for a copy of the print out of any record of committal proceedings conducted in the Local Court by means of an ECM system within the meaning of Schedule 1 to the Electronic Transactions Act 2000.
