Act to amend the
This Act may be cited as the
Criminal Law Consolidation (Throwing Objects at Vehicles) Amendment Act 2006 .
This Act will come into operation on a day to be fixed by proclamation.
In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.
Part 2—Amendment of Criminal Law Consolidation Act 1935
Section 21, definition of
lesser offence , (b)—after "Division" insert:or section 32A
After section 32 insert:
Division 7B—Throwing objects at vehicles
32A—Throwing objects at vehicles
(1) A person must not throw a prescribed object at, or drop a prescribed object on, a vehicle that is being driven on a road or road-related area or being run on a busway, railway or tramway (whether, at the time the object is thrown or dropped, the vehicle is moving or stationary).
Maximum penalty: Imprisonment for 5 years.
(2) In this section—
prescribed object means an object of a class prescribed by the regulations for the purposes of this section;
road androad-related area have the same meanings as in theRoad Traffic Act 1961 ;
vehicle means—
(a) a vehicle that is propelled by a motor; or
(b) a vehicle that is run on a busway, railway or tramway; or
(c) a bicycle, tricycle or other similar vehicle for which the rider provides the motive force; or
(d) a vehicle that is drawn by an animal; or
(e) an animal that is being ridden by a person.
32B—Alternative verdicts If at the trial of a person for murder or manslaughter the jury is not satisfied that the accused is guilty of the offence charged but is satisfied that the accused is guilty of the offence constituted by section 32A, the jury may bring in a verdict that the accused is guilty of that offence.
