1. These regulations may be cited as the Criminal Injuries Compensation Fund Regulations,

1986

2. These regulations shall come into operation on 1 October, 1986.

3. The prescribed percentage for the purposes of section 12(2)(d) of the Criminal Injuries

Compensation Act, 1977, is 20 per cent.

4. (1) Pursuant to section 13(2) of the Act, no levy will be imposed under that section in the

following circumstances:

(a)

where a person is convicted of the offence of truancy under the Education Act, 1972;

(b)

where a person expiates an offence in pursuance of an expiation notice issued by a council;

(c)

where a person expiates an offence in pursuance of an expiation notice issued by a tertiary institution;

(d)

where a person expiates an offence in pursuance of an expiation notice issued by an incorporated hospital, an incorporated health centre or the Institute of Medical and Veterinary Science;

(e)

where a person expiates an offence in pursuance of an expiation notice issued by the Board of the Botanic Gardens.

and

(f)

where a person expiates an offence against the Further Education Parking Regulations, 1980, in pursuance of an expiation notice issued under those regulations.

(2) In this regulation—

"council" has the same meaning as in the Local Government Act, 1934, and includes a body

corporate that is, under any Act, deemed to be, or vested with the powers of, a council:

"incorporated hospital" and "incorporated health centre" mean a hospital or health centre

incorporated under the South Australian Health Commission Act, 1976:

"tertiary institution" means—

(i)             The University of Adelaide;

(ii)            The Flinders University of South Australia;

(iii)           the Roseworthy Agricultural College;

(iv)           the South Australian College of Advanced Education;

or

(v)

the South Australian Institute of Technology.
