Criminal Injuries Compensation Amendment Act 2001

An Act to amend the Criminal Injuries Compensation Act 1976

[Royal Assent 12 April 2001]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Criminal Injuries Compensation Amendment Act 2001 . 2CommencementThis Act commences on a day to be proclaimed. 3Principal ActIn this Act, the Criminal Injuries Compensation Act 1976 is referred to as the Principal Act. 4Section 2 amended (Interpretation) Section 2(1) of the Principal Act is amended as follows: (a) by inserting the following definition after the definition of award : Commissioner means  – (a) a person appointed as a Criminal Injuries Compensation Commissioner under section 2A(1); or (b) a person referred to in section 2A(3); (b) by inserting the following definition after the definition of dependant : Deputy Registrar means Deputy Registrar of the Supreme Court; (c) by inserting the following definition after the definition of offender : Registrar means Registrar of the Supreme Court; 5Section 2A insertedAfter section 2 of the Principal Act , the following section is inserted in Part 1: 2AAppointment of Commissioners (1)  The Minister may appoint one or more people who are legal practitioners to be Criminal Injuries Compensation Commissioners. (2)  An appointment under subsection (1) is subject to any terms and conditions the Minister determines. (3)  For the purpose of this Act, the Master, Registrar and Deputy Registrar are Commissioners. 6Section 3 substituted Section 3 of the Principal Act is repealed and the following section is substituted: 3Provision of Supreme Court Act 1959 not apply Section 5K of the Supreme Court Act 1959 does not apply to any functions exercisable by the Registrar under this Act. 7SubstitutionsEach of the provisions of the Principal Act specified in Column 1 of Schedule 1 is amended by omitting "Master" on the number of occurrences specified in Column 2 of that Schedule and substituting "Commissioner".
