Criminal Code Amendment (Alternative Verdicts) Act 1997

An Act to amend the Criminal Code

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Criminal Code Amendment (Alternative Verdicts) Act 1997 . 2CommencementThis Act commences on the day after the day on which it receives the Royal Assent. 3Principal ActIn this Act, the Criminal Code is referred to as the Principal Act. 4Section 342AA insertedAfter section 342 of the Principal Act, the following section is inserted: 342AAAlternative verdicts Subject to section 332(2) , an accused person charged in an indictment with – (a) attempting to commit a crime may be convicted of committing or attempting to commit any of the alternative crimes available under this Chapter on an indictment charging the accused person with having committed that crime; or (b) being an accessory after the fact to a crime or inciting another person to commit a crime may be convicted, respcetively, of being an accessory after, or inciting that other person to commit, any of the alternative crimes available under this Chapter on an indictment charging the accused person with having committed that crime.
