AN ACT to amend sections six hundred and seventy and six hundred and eighty, and repeal section seven hundred and thirty-five of the Criminal Code.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Criminal

and citation.

Act No. 28 of 1913, as reprinted with amendments to and including Act No. 73 of 1954 incorporated pursuant to the Amendments Incorporation Act, 1938, and further amended by Acts Nos. 11 of 1956, 43 of 1956, 74 of 1956, 50 of 1957, 25 of 1960, 50 of 1960, 28 of 1961 and 35 of 1962.

2. This Act shall come into operation on a day

to be fixed by proclamation.

3. Section six hundred and seventy of the Code is amended by deleting the passage, "or being any aboriginal native," in line two.

4. Section six hundred and eighty of the Code

is amended

(a)

by deleting the passage, "and except in the case of an aboriginal native," in line six; and

(b)

by deleting the paragraph commencing with the words, "The punishment", in line fourteen down to and including the passage, "sergeant." in line seventeen.

5. Section seven hundred and thirty-five of the

Code is repealed.
