Crimes (Validation of Orders) Act 2001†

[Assented to 16 October 2001]

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to amend the Crimes Act 1958 to validate certain orders purported to have been made for the taking of forensic samples from offenders.

2. Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

as at "464ZL. Validation of certain orders

1999 and (1) If, on or before 22 December 2000, an order
amending
Act Nos under section 464ZF(3) is purported to have
26/1999, been made by—
53/2000,
67/2000,
74/2000, (a) the Magistrates' Court not sitting in
86/2000 and open court; or
92/2000. 
LawToday: 
(b) a magistrate not constituting the
dpc.vic.  Magistrates' Court—
gov.au  the order is deemed to have, and always to
have had, the same force and effect as it
would have had if the order had been made
by the Magistrates' Court sitting in open
court.

(2) Sub-section (1) does not affect the rights of

the parties in the proceeding known as
Lednar, O'Brien and Hill v. The Magistrates'
Court and The Chief Commissioner of Police
(Victoria) (No. 6292 of 2000) in the

Supreme Court of Victoria.".
