Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Crimes (Interstate Transfer of Community Based Sentences) Act 2004.

1Name of Regulation

This Regulation is the Crimes (Interstate Transfer of Community Based Sentences) Regulation 2004.

2Commencement

This Regulation commences on 29 November 2004.

3Definition

In this Regulation:

the Act means the Crimes (Interstate Transfer of Community Based Sentences) Act 2004.

4ACT is a participating jurisdiction

The Australian Capital Territory is declared to be a participating jurisdiction for the purposes of the Act.

5Registration of interstate sentences—required details

Schedule 1 sets out the required details that are to be entered in the local register for the registration of an interstate sentence.

1Offender details

The following details regarding the offender:

  • (a)

    names (given and surname),

  • (b)

    aliases (if any),

  • (c)

    date of birth.

2Sentence details

The following details regarding the offender’s sentence:

  • (a)

    name or kind of interstate sentence,

  • (b)

    name or kind of corresponding sentence in New South Wales,

  • (c)

    length of sentence,

  • (d)

    start date,

  • (e)

    date when offender first reported for interstate sentence in participating jurisdiction,

  • (f)

    end date,

  • (g)

    remaining period of sentence to be served in New South Wales,

  • (h)

    sentence history including appeals and registrations in other participating jurisdictions.
