An Act to amend the Crimes (Child Sex Offenders) Act 2005

The Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the Crimes (Child Sex Offenders) Amendment Act 2025.

  2. Commencement

    This Act commences 3 months after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This Act amends the Crimes (Child Sex Offenders) Act 2005.

  4. Review date

    A legislative review is to be presented by the ACT Attorney‑General that ensures relevant stakeholders are adequately consulted and also the potential expansion of ‘child-related employment’ to other legal professionals and other professions. This is to be tabled by the last sitting day of 2025.

  5. What is child-related employment?
    New section 124 (1) (sa)

    insert

    (sa)legal services related to a child, provided by Legal Aid ACT;

    Examples

    1providing advice to a child

    2representing a child in a legal matter

    3representing a person in a proceeding where a child is a witness

  6. Section 124 (2), new definition of Legal Aid ACT

    insert

    Legal Aid ACT—see the Legal Aid Act 1977, section 94 (Commission to operate as Legal Aid ACT).
