Crimes Act 1914. Dated 14 February 2002

These Regulations are the
Crimes Amendment Regulations 2002 (No. 1) .
These Regulations commence on gazettal.
Schedule 1 amends the
Crimes Regulations 1990 .

4BA Definition of authorising persons — prescribed classes (Act s 15XA) For paragraph (b) of the definition of
authorising person in subsection 15XA (1) of the Act, the following classes of persons are prescribed:
(a) if the participating agency is the Australian Federal Police:
(i) any senior executive AFP employee of the Australian Federal Police within the meaning of section 25 of the
Australian Federal Police Act 1979 ; or(ii) any Deputy Commissioner of Police within the meaning of section 6 of the
Australian Federal Police Act 1979 ;(b) if the participating agency is the Australian Customs Service — any Regional Director for a State or Territory within the meaning of section 8 of the
Customs Act 1901 ;(c) if the participating agency is the National Crime Authority — any member of the National Crime Authority within the meaning of section 7 of the
National Crime Authority Act 1984 ;(d) if the participating agency is the Australian Secret Intelligence Organisation — any senior officer of the Organisation as defined in section 24 of the
Australian Security Intelligence Organisation Act 1979 ;(e) if the participating agency is the Australian Secret Intelligence Service (
ASIS ) — any employee of ASIS who is designated as a senior executive employee by the Director-General of ASIS under section 33 of theIntelligence Services Act 2001 ;(f) if the participating agency is the Australian Taxation Office — any Deputy Commissioner as defined in section 2 of the
Taxation Administration Act 1953 .
1. These Regulations amend Statutory Rules 1990 No. 227, as amended by 1991 Nos. 235 and 258; 1992 Nos. 91 and 276; 1994 No. 297; 1995 No. 23; 1996 Nos. 7, 125, 228 and 264; 1997 No. 14; 1998 Nos. 68 and 361; 1999 No. 156; 2000 Nos. 99, 100 and 219; 2001 Nos. 49, 105, 138 and 334.
