Crimes (Administration of Sentences) Act 1999

His Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Crimes (Administration of Sentences) Act 1999.

Explanatory note

The objects of this Regulation are:

(a) to extend provisions relating to restricted associates of an inmate to include persons that the inmate has been directed not to associate or make contact with under certain interim supervision orders within the meaning of the Crimes (High Risk Offenders) Act 2006 or the Terrorism (High Risk

Offenders) Act 2017 (in addition to extended supervision orders under those Acts), and

(b) to transfer, from a governor of a correctional centre to the Commissioner of Corrective Services, powers to prevent a restricted associate from visiting a correctional centre and to prevent an inmate from corresponding or communicating with a restricted associate.

This Regulation is made under the Crimes (Administration of Sentences) Act 1999, including sections 79 and 271 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Crimes (Administration of Sentences) Amendment (Restricted
Associates) Regulation 2018.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Crimes (Administration of Sentences) Regulation 2014

(1) Clause 3 Interpretation

Insert “interim supervision order or” before “extended supervision order” in the definition of restricted associate in clause 3 (1).

(2) Clause 108A Commissioner may bar restricted associates from visiting
correctional centre
Omit “governor of a correctional centre”. Insert instead “Commissioner”.
(3) Clause 108A
Insert “in which the inmate is held” after “the correctional centre”.
(4) Clause 112A Commissioner may prevent correspondence with restricted
associates
Omit “governor of a correctional centre” from clause 112A (1).
Insert instead “Commissioner”.
(5) Clause 119A Commissioner may prevent communication with restricted
associates
Omit “governor of a correctional centre”. Insert instead “Commissioner”.
