CRIMES ACT 1900—REGULATION

(Relating to the form of complaint for an apprehended violence order and the

form of such an order)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Crimes Act 1900, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 19 December 1993.

Amendments

2. The Crimes (Apprehended Violence) Regulation 1990 is amended:

(a) by omitting clause 3 (2);

(b) by omitting clause 4 and by inserting instead the following clause:
Complaints and orders may be made in form approved by the
Minister

4. For the purposes of Part 15A of the Act:

(a)

a complaint for an order may be made in a form approved by the Minister; and

(b)

a court may make an order in a form approved by the Minister.

(c) by omitting Schedule 1.

EXPLANATORY NOTE

The Crimes (Apprehended Violence) Regulation 1990 prescribes forms which may be used for making a complaint for an apprehended violence order and the form that such an order may take. The object of this Regulation is to remove these prescribed forms and instead declare that a complaint for an apprehended violence order and such an order may be made in a form approved by the Minister.

This Regulation is made under section 562Q of the Crimes Act 1900.
