The applicant seeks special leave to appeal from a decision of McKerracher J in the Federal Court of Australia. The resolution of the proposed grounds of appeal would involve the application of settled principles to the particular facts of the case. Moreover, we consider that the proposed grounds have insufficient prospects of success to warrant the grant of special leave. Accordingly, special leave to appeal should be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
