2 Cremation Amendment (No. 1) No. 105, 1994 ˙ Short title 1. This regulation may be cited as the Cremation Amendment Regulation (No. 1) 1994 . ˙ Commencement 2. This regulation commences on 28 March 1994. ˙ Regulation amended 3. This regulation amends the Cremation Regulation 1987 . ˙ Insertion of new s 2A 4. After section 2— insert— ˙ ‘Definition ‘2A. In this regulation— ‘ “Chief Health Officer” means the Chief Health Officer of the department. ’. ˙ Replacement of s 3 (Forms) 5. Section 3— omit, insert— ˙ ‘Forms ‘3.(1) If a provision of the Act or this regulation requires or permits a person to use a prescribed or approved form— (a) the Chief Health Officer must approve a form for the purpose of the provision; and (b) the form approved by the Chief Health Officer is the prescribed or approved form for the purpose of the provision. ‘(2) A person may ask the Chief Health Officer for a document setting out the approved form.
3 Cremation Amendment (No. 1) No. 105, 1994 ‘(3) The Chief Health Officer must promptly comply with the request. ’. ˙ Amendment of s 5 (Duties of officer in charge of crematorium) 6.(1) Section 5(c)— omit ‘ Form 4 of the Schedule to these regulations ’, insert ‘ the approved form ’. (2) Section 5 (at the end)— insert— ‘ Maximum penalty—2 penalty units. ’. ˙ Replacement of ss 6 and 7 7. Sections 6 and 7— omit, insert— ˙ ‘Fee for issue of permission and certificate to cremate ‘6.(1) An application for a permission and certificate to cremate must be in the approved form and accompanied by an application fee of $41.00. ‘(2) The fee is payable to the employer of the medical officer authorised under the Act to give the permission and certificate. ’. ˙ Omission of Schedule 8.
