322 ANNO VICESIMO SEXTO ELIZABETHAE SECUNDAE REGINAE No. 39 of 1978 An Act to amend the CremationAct 1913 -1974 in certain particulars [ASSENTED TO 8TH JUNE, 1978] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Cremation Act Amendment Act 1978. (2) In this Act the Cremation Act1913-1974 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Cremation Act1913-1978. 2. Amendment of s. 5 . Section 5 of the Principal Act is amended by, in subsection (2), omitting the first paragraph and substituting the following paragraph:- "A person authorized by subsection (1) to sign a permission and certificate to cremate a body shall in relation to signing or refusing to sign such a permission and certificate comply with the regulations but in no case shall he sign such a permission and certificate until- (a) there has been furnished to him- (i) a certificate in the prescribed form from the medical practitioner who personally attended the deceased for whose body cremation is being sought; or (ii) a coroner's certificate for the cremation of the body; and (b) he is satisfied, after adequate enquiry, that the body does not contain a cardiac pacemaker or a radioactive implant.".
