Crawford v The State of Western Australia

Her Honour Justice Catherine Patricia Crawford of the High Court of Australia considered a proceeding commenced by Her Honour Catherine Patricia Crawford, a Magistrate of the Magistrates Court and Children’s Court of Western Australia, against the State of Western Australia. The plaintiff sought a declaration that certain amendments made by the Courts Legislation Amendment (Magistrates) Act 2022 (WA) to the Children’s Court of Western Australia Act 1988 (WA) and the Magistrates Court Act 2004 (WA) were invalid. The core of the dispute concerned the plaintiff's contention that powers conferred by the amendments on the President of the Children's Court, allowing them to direct a dually appointed Magistrate to alter the extent of their Children's Court functions at their "absolute discretion," compromised the institutional integrity of the courts contrary to Chapter III of the Constitution. Specifically, the plaintiff argued these powers impaired the independence and security of tenure of Magistrates.

The legal issues before the Court were whether the proposed special case, agreed upon by the parties, was an appropriate form for referring questions of law to the Full Court, and if not, where the proceeding should be remitted. The plaintiff sought to have the matter referred to the Federal Court of Australia, while the defendant proposed remittal to the Supreme Court of Western Australia.

Her Honour refused leave for the parties to state the questions of law in the form of the proposed special case for the opinion of the Full Court. Her Honour reasoned that the special case was not in an appropriate form for referral, citing concerns about the discursive nature of the facts, the relevance of many of those facts, the issues sought to be agitated, and the clarity of the questions posed. Her Honour noted that it was not clear that the special case contained all necessary facts or that the stated questions were the correct ones for determination. Consequently, Her Honour ordered that the proceeding be remitted to the Western Australia Registry of the Federal Court of Australia, allowing the factual and legal issues to be identified and resolved at trial.
