Alteration of other rules of organisation.

  1. On 9 December 2019 the New South Wales Branch of the CPSU, the Community and Public Sector Union, SPSF Group, lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its rules. An additional declaration signed by Branch Secretary Stewart Little was received on 10 February 2020.

  1. The particulars set out alterations to Rules:

    3 – Interpretation;
    5 - Constitution of Branch Council;
    6 – Branch Officers;
    12 – Local Representatives;
    13 – Branch Associates;
    14 – Election of Branch Officers and Delegates to Branch Council; and
    17 – Transition Rule Up to the 2020 Election.

  1. The alterations correct typographical and formal errors, update formatting to provide greater consistency, and update a transitional rule to reflect the most recent amendments. I note that the alteration to rule 5.2, which affects the calculation of the number of reserved positions on Branch Council in the next scheduled election, reinstates words inadvertently deleted when the rules were last amended.

  1. On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.

  1. In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
