COVID-19 Emergency Response (Expiry and Rent) Amendment Act 2020

An Act to amend the COVID-19 Emergency Response Act 2020.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the COVID-19 Emergency Response (Expiry and Rent) Amendment Act 2020.

2Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of COVID-19 Emergency Response Act 20203Amendment of section 3 – Interpretation

Section 3, definition of relevant declaration—after "Emergency Management Act 2004" insert:

or a declaration under section 87 of the South Australian Public Health Act 2011

4Amendment of section 6 – Expiry of Act
  1. (1)

    Section 6(1)(b)—delete "paragraph (a)" and substitute:

    this section

  2. (2)

    Section 6(2)—delete paragraphs (a) and (b) and substitute:

    1. (a)

      28 days after the day on which all relevant declarations relating to the outbreak of the human disease named COVID‑19 within South Australia have ceased; or

    2. (b)

      6 February 2021,

  3. (3)

    Section 6(2a)—delete "and the regulations made under that section will expire on 30 September 2020" and substitute:

    will expire on 6 February 2021

5Amendment of section 8 – Provisions applying to residential tenancies

Section 8(1)(b)—after "otherwise)" insert:

if the tenant is suffering financial hardship as a result of the COVID‑19 pandemic
