COVID-19 Emergency Response (Bail) Amendment Act 2020

An Act to amend the COVID-19 Emergency Response Act 2020.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the COVID-19 Emergency Response (Bail) Amendment Act 2020.

2Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of COVID-19 Emergency Response Act 2020
3Amendment of Schedule 2 – Temporary modification of particular State laws

Schedule 2—after the heading to Schedule 2 insert:

Part A1—Bail Act 1985

A1—Modification of Bail Act 1985

The Bail Act 1985 applies with the following modifications:

  1. (a)

    section 10A(2), definition of prescribed applicant—after paragraph (ca) insert:

    1. (cb)

      an applicant taken into custody on a charge of an aggravated offence against the person if the circumstances alleged to aggravate the offence are those set out in section 5AA(1)(ka) of the Criminal Law Consolidation Act 1935; or

  2. (b)

    section 10A(2), definition of prescribed applicant, (d)—before subparagraph (i) insert:

    1. (ai)

      section 20AA;

    2. (bi)

      section 20AB;

  3. (c)

    section 10A(2), definition of prescribed applicant, (d)—after subparagraph (ii) insert:

    1. (iia)

      section 169;

    2. (iib)

      section 170;

    3. (iic)

      section 170A;
