The Court also found that the Council had taken into account irrelevant considerations, namely concerns about the applicant's character and past conduct, which were not relevant to the assessment of the development application under the relevant planning scheme.

The High Court allowed the appeal, quashed the decision of the West Coast Council to refuse the permit, and remitted the matter to the Council for reconsideration according to law.
