JUDGMENT
HIS HONOUR: In respect of the lack of appearance of the plaintiff or solicitors, I note particularly that Exhibit MDJ3 to the affidavit of Ms Dawson, sworn on the 3rd of August 2007, indicates an awareness that this application is to be heard today, but the solicitor on the record appears to give priority to a trial starting in Brisbane. I can assume from the lack of concern about the substance of the matter before me that the firm really does not oppose the order which is sought. However, if that were to be the case, arrangements should have been made for the Court to be directly informed by those solicitors.
