His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Court Security Act 2005.

Explanatory note
The object of this Regulation is to exempt the following persons from the prohibition in the Court Security Act 2005 against transmitting sounds, images or information about court proceedings from the place where a court is sitting:
| (a) | lawyers and journalists, |
| (b) | persons authorised by or under a court practice note or policy direction, |
| (c) | court officers and court staff. |
This Regulation is made under the Court Security Act 2005, including section 9A (2) (f) (as inserted by the Courts and Other Legislation Further Amendment Act 2013).

1 Name of Regulation
This Regulation is the Court Security Amendment (Exemption)
Regulation 2013.
2 Commencement
This Regulation commences on 1 July 2013 and is required to be published on the NSW legislation website.

Clause 6B
Insert after clause 6A:
6B Exemptions from restriction on transmission of court
proceedingsSection 9A (1) of the Act does not apply to the transmission of sounds, images or information:
(a) by a journalist for the purposes of a media report on the proceedings concerned, or (b) by a lawyer, or (c) by a person who is authorised to do so by or under a practice note or policy direction issued by the senior judicial officer of the court concerned, or (d) by a court officer or member of staff of the court concerned (including a member of staff of a judicial officer of the court) acting in the usual course of his or her duties. Note. This clause only confers exemptions from section 9A (1) of the Act and does not limit any power of a court, judicial officer or other person in relation to the conduct of proceedings or the conduct of persons in court premises. This clause also does not affect the requirements of any other law.
