s1 4 s4 Court Rules Amendment (No. 1) No. 266, 1997 PART 1—PRELIMINARY ˙ Short title 1. This rule may be cited as the Court Rules Amendment Rule (No. 1) 1997 . ˙ Commencement 2. This rule commences on 1 September 1997. PART 2—AMENDMENT OF BARRISTERS ADMISSION RULES 1975 ˙ Rules amended 3. This part amends the Barristers’ Admission Rules 1975 . ˙ Replacement of r 38 (Application for admission) 4. Rule 38— omit, insert — ˙ ‘ Application for admission ‘ 38.(1) A person seeking admission as a barrister must arrange for a notice in the approved form to be displayed in the following places— (a) if the person intends seeking admission before the Court of Appeal— (i) the registrar’s office at Brisbane; and (ii) on the frames provided for the purpose in the hall of the Supreme Court library at Brisbane; (b) if the person intends seeking admission before the court at Rockhampton, Townsville or Cairns—

s5 5 s5 Court Rules Amendment (No. 1) No. 266, 1997 (i) the registrar’s office at the place where the person seeks admission; and (ii) in the Supreme Court library at the place where the person seeks admission. ‘ (2) The notice must be placed at least 10 clear days before the start of the court sitting at which the person intends seeking admission (the “relevant court sitting” ). ‘ (3) The person must also arrange for publication of a notice in the approved form in the following way— (a) if the person intends seeking admission before the Court of Appeal— (i) twice in a newspaper published in, and circulating throughout, Brisbane; and (ii) once in the Queensland Law Reporter weekly publication; (b) if the person intends seeking admission before the court at Rockhampton, Townsville or Cairns—once in a newspaper published in, and circulating throughout, the place where the person seeks admission. ‘ (4) The notice must be published at least 10 days but not more than 21 days before the start of the relevant court sitting. ‘ (5) Further, the person must, at least 7 clear days before seeking admission— (a) pay the fee payable under these rules; and (b) file with the registrar of the court at the place where the person seeks admission an affidavit stating— (i) the person’s qualifications; and (ii) the extent of the person’s compliance with these rules.’. ˙ Replacement of r 40 (Admission to be at sitting of Court of Appeal) 5. Rule 40— omit, insert —

s6 6 s8 Court Rules Amendment (No. 1) No. 266, 1997 ˙ ‘ Admission to be at particular sittings of the Court ‘ 40.(1) A person may be admitted as a barrister at— (a) a Court of Appeal sitting designated by the Chief Justice; or (b) a sitting of the court at Rockhampton, Townsville or Cairns designated by a judge at Rockhampton, Townsville or Cairns respectively. ‘ (2) However, a person may be admitted as a barrister at a sitting of the court at Rockhampton, Townsville or Cairns only if— (a) the person has complied with these rules; and (b) the board has given the person a certificate under rule 39; and (c) no objection to the person’s admission has been given to the secretary.’. PART 3—AMENDMENT OF DISTRICT COURTS RULES 1968 ˙ Rules amended in pt 3 6. This part amends the District Courts Rules 1968 . ˙ Amendment of s 74 (Days on which service not to be effected) 7.
