We, the rule-making committee, make the following rules of court under the Court Procedures Act 2004, section 7.

  1. Name of rules

    These rules are the Court Procedures Amendment Rules 2017 (No 4).

  2. Commencement

    These rules commence on 1 January 2018.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    These rules amend the Court Procedures Rules 2006.

  4. Rule 276 (1) (a)

    omit

  5. Rule 3607E (1) (a)

    substitute

    (a)the School of Legal Practice within the College of Law of the Australian National University;

  6. New rule 3804

    in part 3.12, insert

  7. Correction of name of respondent

    The registrar may at any time correct a mistake, omission or error in the name or identity of the respondent in a proceeding in—

    (a)a document filed in the court in the proceeding; or

    (b)an order made based on the name in the original application.

  8. Rule 4053 (2) (j)

    substitute

    (j)an indictment on which the accused has not yet been arraigned;

  9. Rule 6251 (3) (i), new dot point

    insert

    ·     section 134 (Decision about hearing of application);

  10. New rule 6303 (2) (d), (e) and (f)

    insert

    (d)the seal of the Industrial Court;

    (e)the seal of the Family Violence Court;

    (f)the seal of the Galambany Court.
