Name of rules
These rules are the Court Procedures Amendment Rules 2017 (No 1).
Commencement
These rules commence on 1 May 2017.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Legislation amended
These rules amend the Court Procedures Rules 2006.
New rule 4724
in division 4.3.3, insert
Prosecution application for review of bail decision
(1)This rule applies to an application by the director of public prosecutions for review of a bail decision under the Bail Act 1992, section 44 (Right of review of bail decisions—prosecution).
Note Application must be made using approved form 4.11 (Application for review of bail) AF2017-107.
(2)Part 6.2 (Applications in proceedings) does not apply to an application under this rule.
(3)When the registry is open, the application must be—
(a)filed by delivering it to the registry personally; and
(b)stamped with the date and time of filing.
(4)When the registry is not open, the application must be filed by sending a copy by email to [email protected].
